Although the information in this website is intended to assist you, it does not replace the information contained in the Notice of Proposed Class Action Settlement and Fairness Hearing (“Class Notice”) which can be downloaded from the Documents page.

A proposed class action settlement has been reached, and preliminarily approved by the United States District Court for the District of Montana, that would resolve a class action lawsuit against affiliated companies often generally referred to as Nationwide Insurance or Allied Insurance. (For a legal definition of “Nationwide/Allied” under the proposed settlement, please refer to the Class Notice or the Q & A section of this site.)The Court will hold a fairness hearing as described in the Class Notice to consider final approval of the settlement as fair, reasonable, and adequate.

In the Lawsuit, the Plaintiff alleges that Nationwide/Allied improperly failed to provide “stacked” coverage benefits under Medical Payments, Uninsured Motorist, or Underinsured Motorist Coverages provided in insurance policies issued or renewed in the State of Montana. Nationwide/Allied denies any wrongdoing, and contends that at all times it complied with applicable law.

Claim Forms can be printed for submitting a settlement claim. You can also view the full Settlement Agreement, copies of pertinent Court orders and other court filings, and other information concerning the settlement and the Lawsuits.

The settlement provides for additional insurance benefits to Settlement Class Members upon timely submission of a valid Claim Form. You also have other options under the settlement as summarized below. Get no payment. This is the only option that allows you to ever be part of any other lawsuit about the legal claims proposed for settlement.
Object

Write to the Court about what you don’t like about the settlement.
Go to a Hearing on October 9, 2008 Ask to speak in court about the fairness of the settlement.
Do Nothing Get no payment. Give up rights and release legal claims.
